An attorney provides legal services for a fee and is entitled to request a reasonable advance payment.

The fee for legal services is primarily determined by agreement between the attorney and the client. If no agreement on the amount or method of determining the fee is reached, the fee is determined according to Decree of the Ministry of Justice of the Slovak Republic No. 655/2004 Coll. on attorneys' fees and reimbursements.

Contractual fee

The amount and method of determining the fee can be agreed based on the nature and complexity of the specific legal matter, in particular as:

  • an hourly fee,
  • a flat fee,
  • a contingency fee,
  • a tariff fee agreed differently from the base tariff rate.

These methods may also be combined under the conditions set out in the Decree.

Tariff fee

If no agreement on a contractual fee is reached, the attorney is entitled to the tariff fee under the Decree, the amount of which depends mainly on the value and nature of the legal matter.

Reimbursement of expenses and lost time

In addition to the fee, the attorney is entitled to reimbursement of duly incurred expenses (court fees, travel, expert opinions, translations, extracts from public registers) and compensation for lost time.
